Governing Law: Republic of Uganda

These Terms of Service and Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and the operators of the Ifother platform (“Ifother”, “we”, “us”). Please read them carefully before creating an account or participating in any contest.

1. Definitions

For the purposes of these Terms, the following definitions apply:

“Platform” / “Ifother”
The Ifother application, web service, and associated infrastructure operated under Ugandan law.
“User” / “You”
Any individual who accesses, registers on, or uses the Ifother platform in any capacity.
“Creator”
A User who creates a Contest on the Platform and is responsible for its honest resolution.
“Participant”
A User who joins a Contest by selecting a predicted outcome and contributing a Stake.
“Contest”
A structured, time-bound prediction challenge created on the Platform with defined outcome options, entry requirements, and resolution rules.
“Stake”
The fixed amount contributed by a Participant to a Contest pool in support of their predicted outcome.
“Pool”
The aggregate of all stakes held in escrow for a Contest, distributed to winners upon resolution.
“Wallet”
The in-app account balance maintained by the Platform on behalf of the User, reflecting settled payouts less withdrawals.

2. Eligibility

By using Ifother, you represent and warrant that:

  1. You are at least 18 years of age.
  2. You are a resident of, or lawfully present in, the Republic of Uganda.
  3. You are not prohibited by any applicable law or court order from participating in prediction or challenge activities.
  4. You are using the Platform for personal, social purposes within an established community, group, or social network.
  5. All information you provide during registration is accurate, current, and complete.

The Platform reserves the right to verify identity and age and to suspend or close accounts where eligibility cannot be confirmed. Accounts found to have been created by ineligible persons are void and any associated wallet balance may be withheld pending investigation.

3. Account Registration

  1. Registration requires a valid Ugandan mobile phone number, which serves as your account identifier and payment channel.
  2. Each person may hold only one (1) account. Duplicate accounts are prohibited and may be closed without notice.
  3. You are solely responsible for maintaining the confidentiality of your login credentials. Do not share account access with any third party.
  4. You must notify us immediately at support@ifother.com if you suspect unauthorised access to your account.
  5. The Platform is not liable for losses arising from unauthorised account access caused by your failure to protect your credentials.

4. Nature of the Platform and Its Contests

Ifother is a social prediction and challenge resolution platform. Every contest on the Platform is based on a real-world event with an outcome that is verifiable and directly observable by the people involved.

4.1 Social Context Requirement

Ifother is designed exclusively for use within established social circles — among friends, family, colleagues, teammates, classmates, or members of a shared digital community. You should only create or join contests with people you know personally or are digitally connected to.

The integrity of every contest depends on participants sharing enough context to directly witness or verify the outcome. Using this Platform to engage in prediction contests with complete strangers is outside its intended purpose and is strongly discouraged. The Platform is not a general-public prediction market.

4.2 Transparent, Witnessed Outcomes

Because all contests are based on real events within a shared social context, outcomes are inherently transparent. There is no hidden information, algorithmic determination, or operator-set result. The outcome of every contest is determined by a fact — a thing that happened — that all participants either witnessed directly, were present for, or have equal access to verifying.

This shared-witness model is what makes Ifother fundamentally different from any form of speculative or anonymous market. Participants know the people involved, they know the event, and they know when it will be resolved.

4.3 Peer-to-Peer Structure

Ifother facilitates transactions between Participants. The Platform does not set odds, take positions, or act as a counterparty in any contest. Payouts are determined entirely by participant contributions. The Platform charges a flat service fee as disclosed in Section 5.

4.4 Contests Must Reflect Real Events

Every contest must be based on a genuine, upcoming, verifiable real-world event. Fabricated scenarios, retroactive resolutions, or contests based on random processes are prohibited and constitute a breach of these Terms.

5. Payments, Wallets and Withdrawals

  1. All payments are processed via MTN and Airtel mobile networks through our licensed payment processor.
  2. Stakes are held in escrow by the Platform until the relevant contest is resolved. Escrowed funds are not available for withdrawal while a contest is active.
  3. Winnings are credited to your Ifother Wallet balance upon resolution.
  4. Withdrawals are subject to a 2.5% processing fee deducted from the amount being withdrawn.
  5. The minimum withdrawal amount is UGX 2,000.
  6. Withdrawals are sent to the mobile money number registered on your account. You are responsible for ensuring this number is correct and active.
  7. The Platform is not responsible for failed withdrawals caused by incorrect phone numbers, dormant mobile money accounts, or mobile operator outages. In the event of a confirmed payment failure, your balance will be restored within 24 hours.
  8. Each resolved contest carries a platform service fee of 5% of the total pool, in addition to a 5% creator reward paid to the Contest Creator. Both fees are disclosed to Participants prior to entry.

6. Creator Responsibilities

In addition to the general obligations in these Terms, Users who create contests further agree that:

  1. Every contest must be based on a real, upcoming, verifiable event known to all Participants.
  2. You must declare the correct outcome honestly and without undue delay once the event has concluded.
  3. You must not create contests in which you have the ability to control, influence, or manipulate the outcome.
  4. You must not create contests that involve a conflict of interest that could compromise your impartiality as Creator.
  5. You earn a 5% creator reward from the total contest pool upon valid resolution. This reward is forfeited if the Platform determines the resolution was fraudulent or dishonest.
  6. The Platform reserves the right to override any resolution, cancel a contest, and withhold creator rewards where evidence of fraud, manipulation, or rule violation exists.

7. Prohibited Conduct

You must not, at any time:

  1. Create contests based on events you have the capacity to control or manipulate.
  2. Collude with other Participants to exploit a contest or misrepresent an outcome.
  3. Use the Platform for money laundering, fraud, or any activity that violates the Anti-Money Laundering Act (Uganda), the Financial Institutions Act (2004), or any applicable law.
  4. Create, join, or promote contests with persons you have no social, professional, or digital relationship with.
  5. Register under a false identity or create multiple accounts.
  6. Attempt to reverse-engineer, circumvent, or exploit the Platform's security or payment infrastructure.
  7. Use automated tools, bots, or scripts to interact with the Platform.
  8. Create contests premised on illegal activities, violence, or content contrary to Ugandan law or the Platform's community standards.

8. Dispute Resolution

  1. Contest outcomes are determined by the Creator and any appointed judges using the resolution tools provided on the Platform.
  2. If you believe a contest was resolved dishonestly or in error, you may submit a formal dispute within 48 hours of resolution through the in-app dispute channel.
  3. The Platform's review team will assess disputes within five (5) business days. The Platform's decision is final and binding.
  4. The Platform may, at its sole discretion, cancel a contest, refund stakes to all Participants, or take action against Creators found to have acted in bad faith.
  5. Any unresolved legal disputes between a User and the Platform shall be subject to the exclusive jurisdiction of the courts of the Republic of Uganda, with Kampala as the seat of proceedings.

9. Privacy and Data Protection

  1. We collect the following categories of personal data to operate the Platform: name, mobile phone number, mobile network details, contest participation history, and transaction records.
  2. We process your data in accordance with the Data Protection and Privacy Act (2019) of Uganda.
  3. We do not sell your personal data to third parties for commercial purposes.
  4. Transaction data is shared with our payment processor solely for the purpose of processing payments.
  5. We may disclose data to competent Ugandan authorities — including the Uganda Communications Commission, the Financial Intelligence Authority, and the Uganda Police Force — in response to valid and lawful requests.
  6. By creating an account, you consent to this data processing as described herein.

10. Limitation of Liability

To the maximum extent permitted by the laws of Uganda, Ifother and its operators shall not be liable for:

  1. Indirect, incidental, or consequential losses arising from your use of, or inability to use, the Platform.
  2. Losses caused by technical failures, network outages, or errors attributable to third-party payment processors.
  3. Decisions made by Contest Creators, appointed judges, or other Participants.
  4. Losses resulting from your breach of these Terms or your failure to maintain account security.

The Platform's total aggregate liability to any User for any claim shall not exceed the total amount of service fees paid by that User to the Platform in the twelve (12) months preceding the relevant claim.

11. Account Termination

  1. You may close your account at any time by contacting us at support@ifother.com. Any remaining Wallet balance will be disbursed to your registered mobile money number after identity verification, less applicable withdrawal fees.
  2. The Platform may suspend or permanently close your account for breach of these Terms, fraudulent activity, or account inactivity exceeding twelve (12) consecutive months.
  3. Where an account is closed for cause, creator rewards may be withheld pending investigation and may be forfeited if fraud is confirmed.

12. Amendments to These Terms

We may update these Terms from time to time in response to legal, regulatory, or operational changes. Where we do so, we will notify active Users via in-app notification no less than seven (7) days before the amended Terms take effect. Continued use of the Platform following notification constitutes acceptance of the amended Terms. If you do not accept the amended Terms, you must cease use of the Platform and request account closure.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Uganda, including without limitation:

  • The Electronic Transactions Act, 2011
  • The Computer Misuse Act, 2011
  • The Data Protection and Privacy Act, 2019
  • The Financial Institutions Act, 2004
  • The Anti-Money Laundering Act, 2013

All disputes arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Republic of Uganda.

Acceptance of Terms

By creating an account on Ifother, you confirm that you have read and understood these Terms in their entirety and agree to be legally bound by them. You further confirm that you are at least 18 years of age, that you are eligible to use the Platform under applicable law, and that you will use it solely within the social context for which it is designed.
